Employer Benefit Plans
All small employer groups (2-100 employees) are guarantee issued and cannot be denied coverage. The rate bands are submitted and filed by each insurance carrier annually.
The quoted rates may vary 10% up or down based on the medical conditions within the employers group (RAF or relative adjustment factor). Renewal rate formulas are also provided by the state to assure that all carriers providing small group plans operate within the guidelines of the state.
Large group medical plans (100 employees or more) are quoted by carriers based on actuarial guidelines (age, sex, location, type of coverage requested and medical condition of the group). Therefore, a group medical quotation is not guaranteed. A carrier may decline to quote on a large group based on their particular underwriting requirements.
All group medical plans offered within the State of California must meet the guidelines set forth by the California Department of Insurance. These guidelines include, but are not limited to, mandated benefits that must be included within each policy, discrimination rules and regulations, COBRA rules and regulations, HIPPA rules and regulations and other state law.
The Federal and State government require that all employers meet all rules and regulations set forth in The Consolidate Omnibus Reconciliation Act (COBRA), Health Insurance Portability Act (HIPPA) and The Employee Retirement Income and Security Act. It is imperative that each employer have a thorough understanding of these laws and is implementing them appropriately.
